We All Need Advice From Time To Time

It must be questioned whether the Speaker took qualified legal advice on his interpretation of the Constitution when rejecting a motion from a PH member. According to Press reports he based his rejection on a claim that the motion “questioned the power of the Agong to appoint a Prime Minister”.

Of course it does nothing of the sort. The Constitution permits the Agong to appoint a Prime Minister who “in his judgment” enjoys the support of a majority of the members of the Assembly”.  It does NOT provide that any such judgment is appropriate or accurate. THAT is a matter for the Assembly. If it does not support the nominee Prime Minister he is out on his ear and the Agong has to think again.

So it appears that both the Agong and the Speaker need advice on their roles; and here it is.
